The Ongoing Sneaker Battle: Nike Subpoenas Adidas’ Mark King

Experiencing a slight obstacle against three former Nike designers – Marc Dolce, Mark Miner and Denis Dekovic – Nike has directed their attention to subpoenaing several top executives for adidas AG, including North America head Mark King, executive board member Eric Liedtke, adidas America general counsel Paul Ehrlich and one other executive.

It is reported that adidas is not part of the lawsuit, but these latest subpoenas by Nike was executed to determine if any information were leaked by the three former Nike designers. Nike claims the designers allegedly stole trade secrets before taking their current roles at adidas.

With these latest round of subpoenas, it could require sworn depositions and additional documents, such as emails about the former Nike designers if approved by a judge. Or, the court could reject the subpoenas and deny Nike access to the executives.

Adidas has already provided more than 1,500 pages of records, according to an earlier filing in the case.

“Adidas is not a party to this dispute,” Barran said Monday, in a statement. “The lawsuit is not against Adidas. While it’s not a party to the dispute, the company has been cooperative and will continue to cooperate with every reasonable request from each side.”

So far, Nike has declined to comment on the subpoenas.
